Welcome to Elevated Desert Co. By accessing our website or purchasing our products, you agree to these Terms of Service. Please read them carefully.

Eligibility & age — you must be 21+

You must be at least 21 years of age to use this site or purchase any product from us, and at least the age of majority in your jurisdiction where that age is higher. You must also be able to enter into a binding contract. Access to this site is gated on that confirmation, and by entering the site, placing an order, or accepting delivery you represent and warrant that you meet these requirements.

We may require proof of age at any point — before accepting an order, before shipping, or at delivery — and our carriers may require an adult signature. We may refuse, cancel, or refund any order we believe is placed by, or on behalf of, someone under 21, and we may cancel an order if age cannot be verified. Ordering on behalf of anyone under 21 is a breach of these terms.

Our products are sold as dry herb and tobacco accessories for lawful use only. They are not sold for use with any controlled substance, and nothing on this site is an inducement to use one.

You are solely responsible for knowing and complying with all federal, state, tribal, and local laws that apply to you — including any law governing the purchase, possession, import, or use of smoking accessories or related products where you live or where your order is delivered. Laws differ by state, county, and city, and some jurisdictions restrict or prohibit these products entirely. If a product is not lawful at your delivery address, do not order it. We do not provide legal advice, we make no representation that any product is lawful in your jurisdiction, and we may decline to ship to any address for any reason, including where we believe a sale would be unlawful.

Where you resell our products, you are additionally responsible for holding every licence and permit your jurisdiction requires and for enforcing the same 21+ minimum with your own customers.

Arizona warning

Do not use marijuana if you are under twenty-one years of age or pregnant. Keep marijuana out of reach of children.

Products, pricing & availability

Orders & payment

When you place an order, you authorize us (through our payment processor) to charge your selected payment method for the total amount. An order confirmation does not guarantee acceptance — acceptance occurs when we ship.

Wholesale & affiliate

Wholesale accounts and affiliate participation are subject to approval and any additional terms we provide. Pricing and access may be changed or revoked at our discretion.

Intellectual property

All content on this site — logos, designs, text, images, and the "Elevated Desert Co." and "Stay Elevated" marks — is our property or used with permission, and may not be copied or used without written consent.

Acceptable use

Don't misuse the site: no unlawful activity, interference with the site's operation, scraping, or infringing others' rights. Our products are intended for lawful use only, on the terms set out under Legal use & your responsibility to comply with local law above.

Disclaimers & limitation of liability

The site and products are provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, Elevated Desert Co. is not liable for indirect, incidental, or consequential damages arising from your use of the site or products. Nothing here limits liability that can't be limited by law.

Governing law

These terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law rules.

Changes

We may update these terms; the new date will appear above. Continued use of the site means you accept the updated terms.
